Acceptable Use Policy

This is an agreement ('Agreement') between you and the Xtris Network. This Agreement governs your use of our network, website and Services. This Agreement may be updated from time to time with or without notice to you.

In this document, throughout the website and on any correspondence to you, the Xtris Network may be referred to as: 'we', 'our', 'us', 'The Xtris Network', 'Xtris', 'Xtris IRC Network' & 'Xtris Network'. Connection to and use of the Xtris Network is conditional upon acceptance of any and all applicable policies of the Acceptable Use Policy and its Indemnify and Hold Harmless clause.

In consideration of your use of the Service ('Service'), you represent that you are of legal age (13 and over) to use any Xtris service (see our COPPA document for information) and are not a person barred from receiving services under the laws of your country or applicable jurisdiction.

By connecting to our Network, you are bound by the following terms:

Denial of service ('DDoS') actions or abuse of our system(s) or resources is strictly prohibited
Unsolicited advertising of any kind is strictly prohibited
You must read each server's /MOTD upon connect. The 'MOTD' (Message of the Day) will usually contain policies specific to that server
You must treat other users with respect; harassment and discrimination will not be tolerated. Our network is an 'open' global network, and as such, it contains users of all ages, beliefs, religions and cultures
We strictly prohibit the transfer of illegal miscellaneous through the network; if you spot it, please report it to an online member of staff
Hate speech is strictly prohibited; hate speech includes, but is not limited to, speech which demeans groups of people that is meant to insult or inflame

You also agree to understand that:

By using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will the Xtris Network be liable in any way for any such Content including, but not limited to, any errors or omissions in any Content or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service
You acknowledge, consent and agree that the Network Management may access, preserve and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to:
1. comply with legal process;
2. enforce our Agreement;
3. respond to claims that any Content violates the rights of third-parties;
4. protect the rights, property or personal safety of the Xtris Network, its users or the public
The Xtris Network is a PRIVATE network; by using the Service, you agree to indemnify and hold harmless the Xtris Network, its resource providers, Management, officers, operators, administrators and other agents from any and all claims, all legal liability, costs, expenses, judgments, causes of action, attorney fees, litigation and court costs resulting from your use of the Service, whether directly or indirectly, or by any act or omission. This includes any computer-related damage or loss that may result from the use of, or inability to use, the Service
We reserve the right to suspend or terminate your account and to refuse any and all current or future use of the Service (or any portion thereof)
Material made available from our website does not necessarily reflect the views of the Organisation nor its Management
It is entirely your responsibility to keep your account credentials (NickServ account, website login, etc) safe and secure at all times; under no circumstances should you disclose them to anyone else. You are responsible for all use of the Service accessed via these passwords or personal identifiers including, without limitation, any loss or damages incurred and any breaches of this Agreement, where reasonable care has not been taken to secure your account. If you suspect your account details have been compromised in any way, you are required to alert us immediately
Attempting to access or 'take-over' someone else's account or channel in any form is strictly prohibited and will have serious consequences
IRC is a free and mostly un-moderated media; therefore, we take no responsibility whatsoever for the opinions expressed or the actions taken by users. Absolutely no warranty is either expressed or implied
We allow 'friendly' bots; any warbot or takeover bot will be removed from the network without prior notice. Any bot that does not cause us or our users any grief is deemed acceptable
You are limited to 3 (three) connections per IP/IP block. We understand that this is not fair on Internet cafe's, schools and so forth. If you wish to apply for a Trust, please read this FAQ
No member of Network Staff has the authority to bind the Xtris Network in any legal contract of any kind
We reserve the right to scan your system(s), upon connection, for the presence of open proxies/wingates which could pose a possible security threat to our network and users. More information regarding our ProxyScan Service can be found here
We take absolutely no responsibility for the content of external websites linked from our own
Whilst you are glined from our network, you are forbidden from accessing it from any device. By doing so, you will evade your gline which is classified as computer trespass. You are not obliged to contact us regarding a gline - it is your prerogative whether to do so
If you are found to evade a gline issued against you, the gline will be extended and further evasions may result in your ISP and/or authorities being notified
Channel management is left with the channel manager and user-list staff unless there is a violation of NETWORK policy
The Xtris Staff may interpret this AUP in their own understanding if there is any ambiguity or confusion as to how it applies to your individual circumstance and/or situation

As well as the terms above, you also agree you will NOT:

Upload, post, e-mail, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful or racially, ethnically or otherwise objectionable
Impersonate any person, position or entity or otherwise misrepresent your affiliation with a person or entity
Forge mail headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted to our Services
Infringe upon any party's copyrights or any other legal rights, or to violate any other laws
Reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service, use of the Service or access to the Service

Disclaimer of Warranties:

ALL MATERIALS, INFORMATION, PRODUCTS AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SERVICE (THE 'CONTENT') ARE PROVIDED 'AS IS' FOR YOUR USE. THE CONTENT IS PROVIDED WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. XTRIS, ITS SUBSIDIARIES, ITS STAFF, AND ITS LICENSORS DO NOT WARRANT THAT THE CONTENT IS ACCURATE, RELIABLE OR CORRECT; THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE CONTENT IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS SOLELY AT YOUR RISK

Limitation of Liability:

UNDER NO CIRCUMSTANCES SHALL XTRIS, ITS SUBSIDIARIES, ITS STAFF, OR ITS LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICE. THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF XTRIS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE
